Cashless ATM or Remote ATM? The difference your counsel will ask about

EllaCash payment terminal on a dispensary counter

If you have operated a dispensary for more than a few years, you have probably run a cashless ATM, been pitched one, or watched a neighbor's get switched off. The term now gets applied to almost any terminal that is not a card machine, and that looseness is a problem, because the original model and what came after it are structurally different things.

What the original cashless ATM did

The original cashless-ATM model processed a purchase as if it were an ATM withdrawal: the card networks saw a cash disbursement at an ATM that did not exist, while the customer walked away with product, not cash. Industry analyses now describe that model plainly as no longer compliant, and processors have shut down merchants running it, sometimes with settlement funds frozen.

Why the distinction matters to regulators

Financial institutions that serve cannabis-related businesses operate under specific Bank Secrecy Act expectations, including guidance from FinCEN on monitoring and reporting. A transaction flow that misrepresents what happened at the point of sale does not just create risk for the merchant; it creates risk for every institution in the chain. That is why the parties upstream of you care exactly how a transaction is recorded.

What a Remote ATM flow does differently

Remote ATM cash access keeps two events distinct. First, the customer performs a real, PIN-based, receipted cash-access transaction at the terminal, routed through the ATM network for authorization. Second, the merchant completes the purchase in cash. Each event has its own record, and nothing is disguised as something else.

The questions worth asking any provider

Whether you talk to EllaCash or anyone else, your counsel will want the same things: who the parties in the flow are and what each one does, where the transaction record lives and what the receipt says, how exceptions and disputes are handled and by whom, and what the provider is and is not (EllaCash, for the record, is a financial technology company, not a bank). A provider that cannot put those answers in writing is asking you to carry their risk.
